Trump And Six AI Chiefs Sign A Voluntary "Four Layers" Safety Accord With No Legal Force: Signed Tuesday by Trump and Sundar Pichai, Dario Amodei, Mark Zuckerberg, Greg Brockman, Elon Musk and Jensen Huang, the accord commits each company to internal cybersecurity controls, an internal team that checks those controls are working, an outside operator that independently assesses the models, and an independent board committee that receives the reports. Cruz Blocks Democrats' Bid To Pass An AI Safety Board By Unanimous Consent: Sens. Mark Warner, Brian Schatz and Andy Kim sought Tuesday to pass the Artificial Intelligence Risk Management and Security Act of 2026, which would create a permanent AI Safety Board in the Commerce Department to set evaluation standards and require developers to give it access to frontier models at least 45 days before release. The Commerce chair objected, saying it is "difficult to imagine what an ambitious bureaucrat couldn't shoehorn under this broad authority," and said he will keep working with Democrats on a bill. Senate Votes Today On The House-Passed Data Center Ratepayer Bill, And Democrats Plan To Sink It: Majority Leader Thune filed cloture Monday night on the motion to proceed to HR 9340, the Ratepayer Protection Act, which needs 60 votes. The bill has state utility regulators "consider" standards making large data centers pay for the grid upgrades they cause; Schumer calls it a "fraud" because nothing in it is mandatory, and Democrats see a lifeline for Sen. Jon Husted, its Senate champion, in his race against Sherrod Brown. Link

Raskin Asks Amazon, Google, Meta And Oracle For Their Data Center NDAs With Public Officials: The House Judiciary ranking member sent the letters Tuesday, the Wall Street Journal reported, seeking the nondisclosure agreements the companies have signed with government officials over AI data center projects. He is a sponsor, with Reps. Landsman and Barrett, of the bipartisan No Secrets for Data Centers Act, which would void such NDAs and bar subsidies conditioned on confidentiality. Link

Pennsylvania Senate Committee Unanimously Advances A Ban On Data Center NDAs: SB 1408 (Pennycuick), reported Tuesday by Communications & Technology, bars state and local agencies from signing nondisclosure agreements about the location, construction or environmental footprint of a data center and declares any such agreement void. It now goes to the Senate floor; a separate proposal backed the same day would keep data centers from being classed as public utilities. Link

Mesa County, Colo., Adopts Its 12-Month Data Center Moratorium Unanimously, Effective Immediately: Commissioners voted Tuesday to stop accepting, processing or approving land use applications for data centers in unincorporated areas while the county finishes a land development code that does not currently mention them. Buffalo's Council Approves A Two-Year Data Center Pause At 20 MW, But The Binding Law Comes In October: The Common Council passed Council Member Joe Golombek's resolution calling for a two-year moratorium on facilities drawing 20 megawatts or more, crypto mining included, and creating a nine-member task force to write zoning rules. The pause does not bind until the Corporation Counsel drafts a local law, expected before the council in early October, with a formal vote to follow. Link

Georgetown, Ky., Votes To Draft A Data Center Ban; Lovejoy, Ga., Adopts One: Georgetown's council voted unanimously Tuesday to have counsel prepare an ordinance banning data centers and defining "hyperscale," with the mayor asking that small on-site facilities be spared; it also needs Planning and Zoning approval. Lovejoy's council on Monday banned data centers citywide, a month after Stillwater Development withdrew a 1.25-gigawatt, 3.5 million-square-foot campus proposed near two schools. Link

Florida's Attorney General Asks A Court To Bar OpenAI From Developing New Models Without Third-Party Approval: James Uthmeier's Sept. 28 motion for a temporary injunction, filed in the child-harm suit he brought against OpenAI and Sam Altman in June, asks that the company be enjoined from developing any AI model without independent third-party guardrails and approval, ordered to keep minors off ChatGPT in Florida, and barred from giving the product "human attributes." Nonprofit Sues OpenAI Under California's Anti-Hacking Law Over The Hugging Face Breach: Legal Advocates for Safe Science and Technology filed in San Francisco Superior Court, arguing that about 700 OpenAI agents that stole credentials and took over parts of Hugging Face's systems across six days in July violated the Comprehensive Computer Data Access and Fraud Act and the Unfair Competition Law. The suit seeks an injunction, not damages, and tests whether existing computer-crime law reaches a developer for what its agents do; OpenAI called it "completely without merit." Link
